Services
Smart Reach Solutions provides communication and marketing technology services. Specific deliverables, pricing, timelines and support terms may be confirmed separately through quotation, invoice, written communication or service agreement.
Client Responsibilities
- Clients must provide accurate business, billing and campaign information.
- Clients are responsible for lawful recipient consent, opt-in records and compliance with applicable telecom, messaging, privacy and advertising regulations.
- Clients must not use our services for spam, fraud, misleading content, illegal offers, abusive content or prohibited products/services.
Campaign Approval and Delivery
Campaign delivery may depend on telecom operators, WhatsApp/Meta policies, RCS providers, internet availability, recipient device status, templates, approvals and third-party infrastructure. Delivery speed and success cannot be guaranteed in every case.
WhatsApp API and Third-Party Platforms
WhatsApp Business API and related services may be subject to Meta/WhatsApp policies, template approvals, quality ratings, messaging limits and account restrictions. Clients must follow all applicable platform rules.
Payments
Fees, setup charges, campaign charges, API charges, subscription charges or usage-based charges must be paid as agreed. Services may be paused or terminated for delayed payment, misuse or policy violation.
Content and Compliance
Clients are solely responsible for message content, claims, offers, recipient lists, campaign legality and regulatory compliance. Smart Reach Solutions may reject, pause or remove campaigns that appear non-compliant or harmful.
Intellectual Property
Website content, branding, layouts, text and service materials belong to Smart Reach Solutions unless otherwise stated. Clients may not copy, resell or misuse our materials without permission.
Limitation of Liability
Smart Reach Solutions is not liable for indirect losses, business loss, loss of revenue, blocked numbers, rejected templates, delivery failure, third-party outages, policy enforcement by platforms or telecom operator issues.
Indemnity
Clients agree to indemnify Smart Reach Solutions from claims, penalties, disputes or losses arising from unlawful data use, unauthorized messaging, misleading content or violation of applicable rules.
Changes
We may update these Terms when required. Continued use of the website or services means acceptance of updated terms.
Governing Law
These terms are governed by the laws of India. Jurisdiction shall be Surat, Gujarat, India, unless otherwise required by law.
